Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the website and services operated by The American Truck Inc. ("us", "we", or "our").

Your access to and use of our services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, shippers, carriers, and others who access or use the Service.

1. Brokerage Services

The American Truck Inc. operates exclusively as a property broker, licensed by the Federal Motor Carrier Safety Administration (FMCSA). We are not a motor carrier, freight forwarder, or asset-based provider. We arrange for the transportation of freight by authorized third-party motor carriers.

2. User Accounts and Authority

By submitting a quote request, carrier application, or booking freight through our platform, you represent and warrant that you are legally authorized to act on behalf of your company and bind your company to these Terms and any specific load agreements.

3. Rates and Quotes

Freight quotes provided via our website, email, or phone are estimates based on the dimensions, weight, commodity, and market conditions provided at the time of the request. Final rates may be adjusted if the actual shipment characteristics (e.g., weight, classification, accessorial needs) differ from the quoted parameters.

4. Carrier Network Standards

All carriers contracted through our network operate as independent contractors. While we maintain strict vetting protocols regarding safety ratings and insurance, we do not exercise control over the carriers' employees, equipment, or day-to-day operations.

5. Freight Claims

Because we are a broker, we are not liable for loss, damage, or delay to cargo. Liability rests with the contracted motor carrier under the Carmack Amendment (49 U.S.C. § 14706). We will, however, assist our shippers in filing and facilitating the resolution of freight claims with the carrier and their insurance provider.

6. Payment Terms

Unless credit terms have been explicitly established and approved in writing, payment is due upon receipt of the invoice. Overdue invoices may be subject to late fees, collection costs, and suspension of future services.

7. Intellectual Property

The website and its original content, features, and functionality are and will remain the exclusive property of The American Truck Inc. and its licensors. The website is protected by copyright, trademark, and other laws of the United States.

8. Limitation of Liability

In no event shall The American Truck Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
